Terms and conditions for our holiday prize with Kuoni Canterbury.

  1. The holiday prize is a small society lottery (the “Holiday Prize”) and is open to all residents in the UK aged 18 and over who provide their email address and/or phone number.
  2. Employees of The Marlowe Trust or their immediate family members or households, or anyone else connected with the Holiday Prize may not enter the Holiday Prize lottery.
  3. In entering the Holiday Prize, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
  4. Entrants into the Holiday Prize shall be deemed to have accepted these Terms and Conditions.
  5. By submitting your personal information you agree to receive emails from the Promoter containing offers and developments that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.
  6. The Promoter accepts no responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by The Marlowe Trust.
  7. The closing date of the Holiday Prize is noon on Friday 6 December 2019 (“Closing Date”).  Entries received after the Closing Date will not be considered.
  8. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions.  The draw will be performed by a random computer process.  The draw will take place on 6 December 2019.
  9. The winner will receive a Kuoni holiday for two adults for five nights at Paradisus La Perla (adults only) or Paradisus Esmeralda (family friendly). Occupancy based on an all-inclusive plan in a Paradisus Junior Suite. The prize includes two economy return flights from the UK to Mexico and local transfers in Mexico. Travel is valid until 20 July 2020 subject to availability. The prize is non transferrable and cannot be exchanged for cash.
  10. The Promoter accepts no responsibility for any costs associated with the prize and not specifically included in the prize (including, without limitation, travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses). Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.
  11. You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed.
  12. The winner of the competition will be announced on 9 December 2019 (“Announcement Date”). The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The winner must provide a postal address to claim their prize.
  13. The prize may not be claimed by a third party on your behalf.
  14. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 14 days of notification, the Promoter reserves the right to offer the prize to another entrant selected at random from the entries that were received before the Closing Date in accordance with the process described in clause 8 above. If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner’s prize will be forfeited and the Promoter shall be entitled to select another winner. The Promoter does not accept any responsibility if the winner is not able to take up the prize.
  15. The decision of the Promoter is final and no correspondence or discussion will be entered into.
  16. The prize will be sent to the winner by the Promoter by post.
  17. The name of the winner can be obtained after 14 January 2020 by sending a stamped addressed envelope to the following address: The Marlowe Trust, The Friars, Canterbury, Kent CT1 2AS.
  18. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
  19. The Promoter retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.
  20. The winner may be required to take part in any reasonable promotional activity related to the Holiday Prize and the winner shall participate in such activity on the Promoter’s reasonable request. If you are the winner of the competition, you agree that the Promoter may use your name, voice, image, photograph and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes (in any medium, including still photographs and films, and on the internet, and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same).
  21. The Promoter shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here, and in accordance with data protection legislation. By entering the Holiday Prize, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Holiday Prize entry, and for the purposes outlined in paragraph 14 above.
  22. The Promoter accepts no responsibility for any damage, loss, liabilities, personal injury or disappointment incurred or suffered by you as a result of entering the Holiday Prize or accepting the prize. The Promoter further disclaims liability for any injury or damage to your computer or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the Holiday Prize. Nothing in these Terms and Conditions shall exclude the liability of the Promoter for any loss, damage, personal injury, death, fraud or fraudulent misrepresentation as a result of its negligence.
  23. The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Holiday Prize with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of the Promoter in all matters under its control is final and binding and no correspondence will be entered into.
  24. The Promoter shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
  25. The Holiday Prize will be governed by English law and entrants to the Holiday Prize submit to the exclusive jurisdiction of the English courts.
